1. About Akwaba Food
Akwaba Food is a digital marketplace operated by Techland Sarl, connecting independent cooks and small restaurants ("Vendors") with customers ("Clients") who wish to order authentic African dishes. Akwaba Food provides the technology platform — ordering, secure online payment, and order tracking — but does not itself prepare, cook, own, or sell any of the dishes listed.
2. Accounts
You must provide accurate information when creating an account and are responsible for all activity under it. Vendor accounts are subject to review and approval before becoming active.
3. Orders and payment
All orders must be paid in full online before being sent to the Vendor for preparation. Payments are processed by Stripe (card payments) or CinetPay (Mobile Money, Côte d'Ivoire) — Akwaba Food never stores your card or bank details. A unique QR code is generated for each order and must be shown at pickup/delivery to confirm handoff.
4. Vendor responsibilities
Vendors act as independent professionals, not employees of Akwaba Food. Each Vendor is solely responsible for obtaining any license or permit required by local regulation (including home-kitchen / "cottage food" rules where applicable), for food safety and hygiene, and for the accuracy of their listings. Akwaba Food does not independently verify regulatory compliance and disclaims liability in this respect.
5. Vendor subscription
Access to sell on the platform requires a paid subscription (30-day free trial, then $20/month or $220/year, billed automatically until cancelled). Akwaba Food does not charge any commission on individual orders.
6. Cancellations and refunds
Once a Vendor has started preparing an order, it can no longer be cancelled automatically. For an issue with an order, contact support through the ticket system; refunds are reviewed case by case at Akwaba Food's reasonable discretion.
7. Ratings
Clients may rate a dish only after having actually ordered it. Ratings and comments must be honest and relevant; Akwaba Food may remove abusive or fraudulent content.
8. Prohibited conduct
You agree not to provide false information, attempt to bypass platform security, create multiple accounts to abuse free trials or promotions, or post unlawful, defamatory, or infringing content.
9. Disclaimer of warranties
The platform is provided "as is". Akwaba Food does not guarantee the quality, safety, or regulatory compliance of dishes prepared by independent Vendors.
10. Limitation of liability
To the fullest extent permitted by law, Akwaba Food and Techland Sarl are not liable for indirect damages, including any health or food-safety issue related to a dish ordered from a Vendor. Where liability cannot be excluded, it is limited to the amount of fees actually paid to Akwaba Food by the affected user in the twelve months preceding the claim.
11. Governing law
These Terms are governed by the laws applicable in the jurisdiction where Akwaba Food operates for the relevant user (Côte d'Ivoire or the United States, depending on where you are located), without prejudice to any mandatory consumer-protection rules of your own country of residence.
12. Changes
Akwaba Food may update these Terms from time to time; continued use of the platform after a change constitutes acceptance of the updated Terms.
